The purpose of the draft law is to regulate improvement of efficiency of Ukraine’s existing system of control over economic concentrations, including:
1) the implementation of the provisions of paragraphs 2.1 – 2.4 of Chapter IX “Regulatory policy, business development and competition support”)” of the Coalition Agreement;
2) the implementation of Article 256 “Harmonization of laws and practice of implementation” of the Association Agreement which necessitates, inter alia, the implementation of articles 1 and 5 (1) – (2) of the Council Regulation (EC) №139 / 2004 of 20 January 2004 on the control of concentrations between entities;
3) the implementation of paragraph 73 of the Action Plan for deregulation of economic activities and simplification of the regulatory framework that provides for revision of the system cost factors, which is necessary to do to obtain the approval of the Antimonopoly Committee of Ukraine in terms of cost increase ??and potential influence of the concentration on the competition in Ukraine.
