To declare admissible the evidence actually derived from the crime – illegal audio, video monitoring of a person; audio and video monitoring of the place of observation over a person, etc directly contradicts the provisions of paragraph 3 of Article 17 of the Constitution of Ukraine.
It leads to denial of the rule of law, legality, presumption of innocence, and the right to the protection of competition.
It creates opportunities for blackmailing the officials by the mere fact of appealling / non-appealing (on corruption charges) to the court.
