In November 2017, 47 MPs signed a constitutional petition with regard to the unconstitutional procedure for selecting candidates for the position of a Constitutional Court judge through parliamentary factions and groups.
Member of the Board of the Centre of Policy and Legal Reform, Yuliia Kyrychenko, and a MP Viktoria Ptashnyk filed and registered a document with the Constitutional Court of Ukraine on November 28, 2017.
On April 18, 2019, a year and a half after the petition submission, the Grand Chamber of the Constitutional Court of Ukraine considered the issue of initiating constitutional proceeding in a case under the constitutional petition of 47 MPs of Ukraine* at its meeting.
The Grand Chamber of the Constitutional Court of Ukraine has DENIED the initiation of the constitutional proceeding.
Consequently, the CCU itself refused to defend its independence without any legitimate reasons.
Let us remind you that the experts of the Reanimation Package of Reforms have repeatedly warned the CCU of the unconstitutional procedure for selecting candidates for the position of a Constitutional Court judge through parliamentary factions and groups. The Centre of Political and Legal Reform and the Reanimation Package of Reforms initiated a constitutional petition on the verification of compliance of the Rules of Procedure of the Verkhovna Rada of Ukraine (regarding the submission of a proposal for a candidate for the position of a CCU judge by a parliamentary faction (MP group) with the Constitution of Ukraine Art. 208-4 in November 2017. In January 2019, RPR once again called on the CCU to pay attention to the unconstitutionality of the selection of judges, while NGOs issued a relevant statement.
