RPR Calls on the High Qualification Commission of Judges and the High Council of Justice to Ensure Transparency

After the constitutional amendments regarding judiciary came in force in autumn 2016, the role of judicial self-government bodies in the restoration of confidence in the judiciary has substantially grown. The High Council of Justice has been granted disciplinary powers and the obligation to ensure independence of judges and the authority of justice, while the High Qualification Commission of Judges holds a competition to fill the vacancies in the new Supreme Court. Public confidence in the judiciary depends on the transparency of these and other actions.

So far these agencies have not demonstrated the level of transparency expected by the public. Moreover, there is a dangerous tendency of roll-back of previous positive achievements.

The High Council of Justice has stopped webcasting live its meetings where disciplinary cases against judges are being considered, although it has been done before and there are technical capacities to do it.

Despite legal requirements, the High Council of Justice has not published on its website the register of judges’ notifications on interference into their work. The Council of Judges which used to fulfill this function published the relevant register even though the law had not required it.

The High Qualification Commission of Judges has not provided free online access to the portfolios of judges and the candidates to the offices of judges, although according to the law it should have done it last year. Competition entries of the new Supreme Court candidates have not been published either, although they are being scanned. Practical tasks given to the candidates have not been made public.

This might bear a negative impact on the confidence in the actions taken within the judicial reform.

The Reanimation Package of Reforms is ready to cooperate with the High Council of Justice and the High Qualification Commission of Judges to implement these and other actions in order to strengthen public confidence in the judiciary.
