This draft law will establish transparent, clear, and predictable approaches to the calculation of fines by the Antimonopoly Committee of Ukraine for the violation of legislation on the protection of economic competition. The draft law will facilitate the introduction of the principles of proportionality, legal certainty, and non-discrimination in the activities of the Antimonopoly Committee of Ukraine, and it will increase the transparency and predictability for enforcement entities. The above, among other things, will facilitate: a) the application of common approaches by the Antimonopoly Committee of Ukraine to entities in determining the fines that will reduce the number of decisions taken by the discriminatory approach; b) prevent violations of the legislation on protection of economic competition (general and special prevention); c) protect the interests of business entities; and d) increase the investment attractiveness of Ukraine and competition in general.
