Diplomatic breakfast “The closing stage of the Supreme Court Competition”

We would like to cordially invite you to the diplomatic breakfast “The closing stage of the Supreme Court Competition”, which will take place on September 22 (Friday), at 09:30 am – 11:00 am at INVERIA flow space (49A, Volodymyrska str.,1st floor, meeting room “Studio”). The event will start with a welcome coffee at 9:00 am.

During September 14-25, 2017, the High Council of Justice is considering 120 recommendations by the High Qualifications Commission of Judges of Ukraine concerning the winners of the competition. Following these meetings, the High Council of Justice will decide on the candidates to be submitted to the President of Ukraine for appointment, and the President will NOT have the discretion to refuse in appointment to those submitted.

The public is concerned that out of 120 finalists, as many as 30 received negative conclusions from the Public Integrity Council and do not meet the criteria of integrity and professional ethics. Another serious concern is that a number of members of the High Council of Justice have conflicts of interests (their profiles are available here).

Since the meetings have already started, there have been some worrying tendencies concerning the transparency and objectiveness of the procedure itself. In particular, on September 12, 2017, 52 candidates to the Supreme Court submitted petitions of recusal from the competition. However, only 4 candidates were disqualified by the High Council of Justice based on their petition. For that reason, the public has reasonable doubts as to this stage of the competition.

Moreover, we would like to keep you updated regarding the status of draft laws on the anti-corruption court.

So how the High Council of Justice would decide on the future candidates? Would the procedure meet the requirement of transparency and objectiveness? Who are those candidates who have a good chance to enter the Supreme Court, despite the negative opinions of the Public Integrity Council? Is there any possibility to alter the list of the would-be judges of the Supreme Court at this point? And, finally, can we count on the new quality of justice with this Supreme Court composition?
